Acceptance
The acceptance of your order for a Product is expressly conditioned to the acceptance of the Buyer of all of the terms and conditions included in this document and in any package, commercial invoice, user manuals and or datasheets from dmq that in its whole will constitute a complete contract between parties. In the case of inconsistencies between the terms and conditions established in this document and the contents of any package, user manual or datasheet from dmq, these terms and conditions will prevail. All that has been mentioned herein replaces a purchase order from the Buyer or other forms of purchase, should there be any, and DEMEQ S.R.L. rejects, does not agree and is not subject to any terms and conditions included in the purchase order from the Buyer or other forms of purchase. In the event that dmq does not oppose specific provisions included in the forms submitted by the Buyer this does not mean and will not be considered acceptance of those provisions or resignation of the terms and conditions from dmq. Unless the Buyer notifies dmq in writing within ten days from the invoice date of any objection to the terms and conditions of dmq, acceptance of the buyer for all of the dmq terms and conditions will be assumed.
Title and risk of loss
The title and the risk of loss or damage of the Product will go to the Buyers plant Exworks dmq.
Payment terms
Payment terms are shown in the commercial invoice and will be effective on the date of the commercial invoice. All amounts are expressed in United States dollars. Payments can be made with Master Card, Visa, Discover, American Express, certified check, electronic wire transfer or a company check. Any unpaid amount will result in a 1,5% monthly interest from and after the effective payment due date.
Taxes and fees
When required by law, dmq will charge federal, state and or local taxes as well as other taxes as requested by the Buyer. Taxes are added to the purchase price of the Product that is subject to a purchase order. The Buyer will send the correct tax unless it is tax exempt and dmq gets a signed copy of the tax certificate exemption to be filed. In the event that dmq does not get paid on a required tax, the Buyer will be responsible for payment directly to the corresponding fiscal authority.
Warranty
This limited warranty applies only to dmq brand products, for the corresponding period specified for each component, and is valid from the purchase date shown on the receipt and/or purchase invoice.
1. Warranty periods for new units by component:
- Electronic units: 3 years, extendable to 5 years by registering the device within the first year of purchase at our website www.demeq.com
- Electronic units with integrated sensor: 2 years.
- Sensors and replacement parts: 6 months.
- Cables, peripherals and accessories (e.g. interfaces, foot switch, etc.): 3 months.
- Rechargeable batteries: 1 year.
2. Warranty coverage for new units
- This warranty covers both parts and labor.
- Cases, standards and gauges are not covered by this warranty.
- Shipping and return costs for the instrument are not covered by this warranty.
- Warranty only covers shipping and return costs for the repair of new units purchased within 10 business days; after this period, shipping costs are not covered.
- Warranty for sensors, accessories, spare parts or consumables does not cover shipping costs under any circumstances.
- Components repaired under warranty retain their original warranty as described in point 1, counted from the purchase date.
3. Warranty limitations
- DEMEQ is not responsible under any circumstances for losses, damages or delays caused by shipping, whether during shipment or return of the device for service.
- DEMEQ is not responsible for replacement or exchange costs of equipment carried out by third parties (distributors, resellers, etc.) without prior written authorization.
4. Cases not covered by this warranty
- Damage to the exterior of the casing.
- Breakage, impacts, drops or scratches caused by transport of any kind.
- Personal or property damage that may result from improper use of the device, including lack of maintenance.
- Damage caused by other devices connected to the product not supplied by DMQ (e.g. charger or cables).
- Damage caused by lack of equipment maintenance.
- Defects caused by the use of software (programs), interfaces, parts or supplies not provided and/or authorized by demeq.
- Any failure or damage caused by external factors such as rust, cracks, temperature deformations, evidence of overload, sulfated batteries, etc.
- Any failure or damage caused by improper use beyond the working conditions established in the specifications (e.g. inadequate voltage and/or polarity, excessive humidity or temperature conditions, etc.)
- When the product has been used under conditions other than normal or is intended to be used for a purpose other than that for which it was designed.
- Any damage caused by natural disasters, such as earthquakes, fires, floods, electrical discharges or similar events.
- If the product failure is generated by not following the recommendations in the user manual.
- The warranty does not cover cosmetic deterioration or deterioration caused by normal wear and tear.
5. Events that void this warranty
The warranty for the device, accessories and other parts will automatically expire in the following cases:
- Once the warranty period has expired, counted from the date shown on the purchase invoice issued to the end user of the unit.
- Use of batteries and/or chargers with characteristics other than those specified in the user manual.
- Modifications, repairs and/or opening of devices, sensors, accessories or peripherals by unauthorized personnel.
- When the product does not have a serial number or when it has been altered.
6. Evaluation of defects
The evaluation of devices, sensors and accessories with defects will be carried out within 10 business days from the moment they are received at our facilities or those of an authorized distributor. Within this period, the customer will be informed whether the defect is covered by the warranty, and if not, a repair quote will be provided.
Repair timelines will be determined during the device evaluation.
No repair work will be carried out for failures covered or not covered by the warranty without prior customer authorization.
In the event of no warranty coverage, a diagnosis and corresponding repair quote will be sent.
7. Recommendations
To avoid delays and problems with shipments, before sending a device for evaluation and/or repair, please contact us or an authorized distributor to arrange the shipment.
To speed up the service, it is recommended to detail the problem for which the device was sent. The more information you can provide about the problem, the faster we will be able to resolve it.
8. Regarding data on devices to be repaired
If valuable information is stored on the instrument, it is the user's responsibility to download and back up that information before sending the device for repair or maintenance. DMQ is not responsible for the loss or alteration of such information.
Annex I - Warranty coverage for repairs of out-of-warranty equipment
- Repairs carried out outside the original warranty period of the device carry a warranty of 3 (three) months from the date of collection (covering only the repair performed) and do not cover shipping or return costs.
- The repair warranty outside the original warranty described in point A of this annex is subject to the limitations detailed in points 3, 4, 5 and 7 of this warranty policy.
Dmq Technical Service
- Service Request
The customer must request technical service through the corresponding form on our website. It is important to provide all the necessary information for an adequate diagnosis of the equipment. - Equipment Reception
Once the customer has sent their equipment, DMQ will proceed to receive it at our repair center. The customer must attach the registration document generated when making the service request online. - Diagnosis
The equipment will be diagnosed by our technicians to verify the faults reported by the customer and evaluate the scope of the repair. In the case of equipment that requires certification, it will be verified that the equipment is functioning correctly before proceeding with the certification process. - Quotation
After the diagnosis, a quotation for the repair and/or certification will be prepared and sent to the customer by email. If the equipment is within the warranty period, the repair will be covered by DMQ, according to the warranty conditions established on our website. - Quotation Acceptance
Once the customer approves the quotation, the repair and/or certification of the equipment faults will proceed. - Completion and Equipment Pickup
When the repair and/or certification is complete, the customer will be contacted by our team to coordinate payment, if applicable, and the pickup of the repaired equipment.
Standard Repair Time
The standard repair time for equipment is approximately 20 business days, subject to the customer's approval of the quotation within 2 to 3 days after its submission.
Equipment Reception and Delivery
The reception and delivery of the equipment are the sole responsibility of the customer. The customer must manage both the shipment of the equipment to our repair center and the pickup of the equipment once the repair or certification is completed.
Limted responsibility
UNDER NO CIRCUMSTANCE WILL DMQ, ITS DIRECTORS AND/OR THE DMQ STAFF BE RESPONSIBLE FOR ANY INDIRECT DAMAGE, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY, INCLUDING, WITHOUT LIMITATION, ECONOMICAL LOSSES, BENEFITS LOSSES, LOSS OF CLIENTS, REGARDLESS OF WHETHER DMQ WAS INFORMED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FAILURE OF THE SPECIFIC ESSENCE OF ANY LIMITED RESOURCE. THE MAXIMUM RESPONSIBILITY OF DMQ IS FOR THE PRICE OF THE PRODUCT AQUIRED BY THE BUYER REGARDLESS OF ANY FORM OF LEGAL ACTION OR OTHERWISE INITIATED BY THE BUYER.
